The Trademark Filing Pipeline
A trademark is a unique visual symbol, logo, name, signature, or word that distinguishes your products or services from others. In India, securing this registration is governed by the Controller General of Patents, Designs and Trademarks.
Brand Availability Search
Conduct a thorough search in the IP India public database to ensure your proposed mark isn't identical or deceptively similar to any existing registered trademarks.
Select Nice Class
Select the correct class for your business from the Nice Classification system (containing 45 classes: 1 to 34 for goods, 35 to 45 for services).
File Form TM-A
Submit the application online with details of the proprietor, class, description of services, and a high-resolution logo mockup. Once filed, you can use the ™ symbol.
Examination & Publication
The Trademark Registry reviews the application. If no objections are raised, it is published in the Trademark Journal. After 4 months of no opposition, the ® registration certificate is issued.
Filing Checklist
- Proposed Brand Name / Logo Image
- Date of first use (User Affidavit if used prior)
- Incorporation Certificate or Partnership deed
- Signed Power of Attorney (Form TM-48)

Get TM Filed NowAvoid These Trademark Obstacles
Incorrect filing or generic names will result in quick objections or absolute grounds for refusal.
Generic/Descriptive Names
You cannot trademark generic names like "Sweet" for sugar or "Fast" for shipping services. Marks must be distinctive.
Trademark Infringement
Using a phonetic spelling similar to an established brand (e.g. "Koka-Kola") will trigger immediate litigation and opposition.
Missing Classes
Filing in only one class while your startup operates across sectors leaves your brand unprotected in other fields.
